Attorney requests court deny landfill zoning appeal

The state Court of Appeals should deny the motion filed by Seneca Meadows Landfill, the town of Waterloo and the town Zoning Board of Appeals to either reargue a unanimous Appellate Court ruling that went against them or appeal it to the Court of Appeals, the state’s highest court.

That’s the position of attorney Douglas Zamelis, lawyer for North Road property owner Dixie Lemmon, and Concerned Citizens of Seneca County.

The Fourth Department Appellate Division Court has ruled in favor of Lemmon and CCSC in stating that the town cannot issue a permit for the landfill to use an R-1 zoned strip the west side of Burgess Road as a haulageway for trucks to bring soil from Meadow View Mine to the landfill.

Zamelis submitted a written argument against any further consideration of the Appellate Court’s ruling.
