Seneca Falls man arrested again, faces new felony charge

On Wednesday, April 11th at 1:30 p.m., the Town of Seneca Falls Police Department reported the arrest of a 30-year-old Seneca Falls man on two charges related to an order of protection issued last month.

David P. Fenton, 30, was charged with one count of Aggravated Family Offense and one count of Criminal Contempt in the First Degree. Both charges are class E felonies.

Fenton is said to have violated a stay away order of protection that was issued out of the Town of Seneca Falls Court last month by being in the same apartment as the protected party.

Fenton was arraigned in the Town of Seneca Falls Court and committed to the Seneca County Correctional Facility on $3,000 cash bail. He will re-appear in court on Monday, April 16th at 5:00 p.m. for a felony hearing.

On Thursday, April 5th at 7:24 p.m. the Town of Seneca Falls Police Department arrested following a series of events in Seneca Falls, and Seneca Falls Town Court.

David P. Fenton, 30, of Seneca Falls is accused of contacting another town resident multiple times via phone and left threatening messages. At the time of the incident, Fenton and the victim were engaged in a relationship, which made the offense a designated family offense. Therefore, in addition to the two counts of second-degree aggravated harassment, Fenton was also charged with two counts of an aggravated family offense, a felony.

He was arraigned in the Town of Seneca Falls Court.

During arraignment, Fenton became belligerent and unruly – failing to comply with the judge’s order to maintain his composure. Fenton was removed from the courtroom by police and received an additional charge of criminal contempt by the court.

Fenton’s original arraignment was never completed. As a punishment for the criminal contempt, Fenton was committed to the Seneca County Correctional Facility for twelve days and ordered to pay a fine of $500.00.

The Seneca County Correctional Facility released Fenton after he posted the $500 fine. However, because Fenton’s original arraignment was never completed, the Town of Seneca Falls Court issued an arrest warrant for the pending charges.

On Saturday at 11:15 p.m. police located Fenton at his last know residence. After he was observed the police at his door, he hid in the second-floor bathroom. After gaining entry into the residence, Fenton locked himself in the bathroom and refused to exit after being told he was under arrest.



Eventually, police made entry into the bathroom and took Fenton into custody. In addition to the arrest warrant, Fenton received an additional charge of resisting arrest.

Fenton was arraigned in the Town of Seneca Falls Court where he was re-committed to the Seneca County Correctional Facility in lieu of $2,500 cash bail.

He’s is due back in town court at a later date.
