Penn Yan man found guilty of selling cocaine

A Yates County jury convicted a local man of felony drug charges Friday following a trial.

In a press release, District Attorney Valerie Gardner said James F. Fenton, 57, was found guilty of third-degree criminal sale of a controlled substance and third-degree criminal possession of a controlled substance (class B felonies).

The charges stem from the possession and sale of cocaine by Fenton and his son, Tyler Fenton, during November 2016 in Penn Yan.

Following the verdict, Judge Jason Cook remanded Fenton to jail. He faces up to nine years in prison when he is sentenced Feb. 15.

Gardner said Tyler Fenton, who previously pleaded guilty to third-degree criminal sale of a controlled substance, is serving a term of probation with drug treatment court.

Gardner prosecuted the case. Fenton was represented by attorney Tiffany Sorgen, the county’s conflict defender.

Gardner credited the work of sheriff’s office investigators Arlyn Cunningham and Patrick Breuer, who supervised the controlled buy with a confidential informant.
