The state Attorney General’s Office has filed a motion to dismiss claims filed by city property owners against two state agencies over soil contamination in the Geneva Foundry neighborhoods.
Oral arguments on the motion will be 2 p.m. July 12 in the New York State Court of Claims, 144 Exchange Blvd., third floor, Rochester, before Judge Debra Martin.
The claims allege personal injury and property damage as a result of lead and arsenic contamination from the foundry, which operated at 23 Jackson St. from 1868 to 1988, emitting lead and arsenic particles into the air that settled in the soil of the homes and businesses around the site.
According to Thomas Ramsey, assistant attorney general, the claims should be dismissed against the state agencies for two reasons.
