In what his attorney described as a best-case scenario, a Covert man was convicted of assault for injuring his estranged girlfriend with a knife — but was acquitted on more serious charges.
After deliberating for about two hours, the last 90 minutes of which occurred Monday, a Seneca County jury found Don Sipp guilty of second-degree assault, a class D felony punishable by up to seven years in prison. He was found not guilty of second-degree attempted murder and two counts of first-degree assault, class B felonies with a maximum sentence of 25 years behind bars. Sipp also was acquitted of third-degree criminal possession of a weapon, a class D felony.
“This is the best possible outcome for Mr. Sipp,” said his attorney, Rome Canzano, a former prosecutor with the Cayuga County District Attorney’s Office. “He never denied engaging in the conduct that resulted in serious physical injury and admitted he was intoxicated.”
