When Shawn Evans pleaded guilty to failing to register a change of address as a sex offender last month, the court initially agreed to sentence him to one year in Cayuga County Jail. But when Judge Thomas Leone learned it was Evans’ third failure to report his address, he said the punishment did not fit the crime.
Evans, 37, of Martville, was first convicted of second-degree rape in 2000 and rated a level 1 sex offender. As such, he was required to notify authorities of any change of address within 10 days, but Cayuga County District Attorney Jon Budelmann said Evans repeatedly failed to do so.
In 2006, Evans committed his first failure to register his address, a class E felony. Then, in 2010, he was convicted of the same crime and sentenced to one year in jail.
On March 29, Evans appeared in Cayuga County Court again — this time, for failing to register a new address last fall. Budelmann said Evans had moved in September, but did not inform authorities for several months.
