Broker of Owasco Country Club sale awarded $124K for breach of contract by club

The Supreme Court of the State of New York has awarded Owasco broker Michael DeRosa a judgment for breach of contract by the Owasco Country Club after the sale of the property in late 2015.

According to court documents provided by DeRosa in a news release, the amount of the Jan. 22 judgment is $124,300.06. The judgment covers DeRosa's brokerage fee of $88,302.39 plus interest and legal fees. The court's decision upheld an arbitration award from the summer.

DeRosa's attorney, Al Fazio, said that his client had an exclusive contract to list the club for sale for several months. But in December 2015, the club transferred the property to a member, Gerald Crowley, for $883,023. Because DeRosa wasn't compensated for 10 percent of the sale price, per his contract, he and Fazio took the matter to arbitration.
