The New York State Commission on Judicial Conduct announced on Monday that Rose Town Justice Gary M. Poole will resign from office effective July 1st.
The move is part of terms agreed to by the Commission, as well as Poole after a lengthy investigation into complaints that he engaged in repeated, undignified, and discourteous conduct toward a woman with whom he had a romantic relationship.
In a released statement from Robert H. Tembeckjian, Administrator, Justice Poole alleged to have yelled demeaning and derogatory things about the female, as well as her new boyfriend in public. He also threatened her with prosecution, demanded the return of certain personal property, and even threatened to encourage her ex-husband to commence a custody battle involving her children.
Justice Poole has served in Rose Town Court since 1993, but is not an attorney. His current term would have expired this year.
Judge Poole waived the statutory provision of confidentiality applicable to Commission proceedings, to the limited extent that the stipulation and order accepting it and closing the case would be public.
It’s unclear if any candidates are circulating petitions to run in November’s election.
