Cayuga DA Budelmann secures 15-year conviction of Auburn man

District Attorney Budelmann announced today that his Office secured the conviction of Jkendrick Agee (DOB 8/10/1991) on one count of Promoting Prison Contraband in the First Degree, a class D felony. The jury found that Agee, on February 28, 2016, while confined as an inmate at the Auburn Correctional Facility, possessed a weapon consisting of a razor-blade weapon wrapped with electrical tape and a cardboard sheath. The weapon was found by corrections staff during a routine search.

Today Agee was remanded back to the Cayuga County Jail while awaiting sentencing, as he was released from state prison shortly after this charged incident and was housed in Cayuga County Jail while awaiting trial. Previously Agee was convicted of Robbery in the Second Degree in Niagara County and sentenced to 42 months in prison, released from prison and returned to prison serving additional time on a parole violation.

Assistant District Attorney Brian Leeds prosecuted the case and trial, which began Monday with jury selection. The jury returned the guilty verdict at around 10:30 AM today, November 17, 2016, after several hours of deliberation. Stanley faces up to 3 ½ to 7 years for this conviction when he is sentenced January 19, 2017.

District Attorney Budelmann stated: “We thank the jury for taking the time to review the facts in this case and are obviously pleased with the verdict. Dangerous contraband and weapons continue to be an exceedingly serious, daily problem affecting the safety of both the prison staff and the inmates. Today’s verdict is a credit to the hard work of the Department of Corrections staff and ADA Leeds. The diligence the brave corrections officers exert in finding and recovering these items not only makes us all safer and helps this office hold these perpetrators accountable.”
