Penn Yan man charged with felony DWI, had two prior convictions

Police arrested a 47-year-old Penn Yan man following the report of a person, unconscious inside of a vehicle.

Penn Yan Police say that on April 26th at approximately 12:36 p.m. Arthur N. Smith, 47, was charged with driving while intoxicated, which was classified as a felony — due to two previous DWI convictions.



Police were notified by staff at the Gulf Station on Liberty Street that a male driver was unconscious inside a vehicle. Smith was placed through field sobriety tests, which he failed — and was transported to the Yates County Jail for a chemical breath test.

He refused that test, according to police. He was remanded to the Yates County Jail in lieu of $5,000 cash bail or $10,000 secured bond.

The charges will be answered at a later date.
