Seneca Meadows lawsuit against town over local law delayed to June

The Article 78 lawsuit filed by Seneca Meadows Landfill against the Town Board over its 2016 adoption of a local law will not be heard April 17, it was announced at Tuesday’s board meeting.

Town Attorney David Foster, in response to comments from town resident Valerie Sandlas, said that the State Supreme Court Judge assigned to the case has moved the date to June, possibly June 27, in Rochester.

The landfill filed the petition in November, claiming Local Law 3 of 2016 should be null and void. The law would have required the landfill to close by Dec. 31, 2025, and not allow any new solid waste disposal facilities in the town.

The latest lawsuit revives a similar Article 78 filed by the landfill Feb. 3, 2017, after Local Law 3 was passed. While that lawsuit was pending, the Town Board voted May 5, 2017, to pass a local law that rescinded Local Law 3. Seneca Meadows dropped the lawsuit June 14, 2017.
