Penn Yan man with past DWI conviction, charged with DWI again

On March 30th at approximately 1 a.m. police initiated a traffic stop on Clinton Street in Penn Yan, which resulted in the arrest of a 39-year-old Penn Yan resident.

Derek J. Archer, 39, was charged with felony DWI, failure to keep right, failure to stop at a stop sign, speeding and no turn signal after he was observed committing multiple traffic violations.

The violations took place on multiple streets throughout the village, according to police. Upon investigation it was determined that Archer was under the influence of alcohol — and he had a previous DWI conviction.

Police say that due to poor weather conditions — Archer was taken to the Yates County Public Safety Building garage to take field sobriety tests, which he failed.

He refused a chemical test, according to police, who say that he had a previous DWI conviction in the last ten years.

Archer was released on his own recognizance.
