Ruzicka plea, sentencing postponed to March 23rd

The possible plea and sentencing of former Town Board member Thomas Ruzicka has been postponed until March 23.

Ruzicka was scheduled to be in Waterloo Town Court this morning to possibly plead guilty to second-degree harassment, a violation, in lieu of going to trial. According to a plea offer made at a Jan. 26 court appearance, Ruzicka was given a month to consider an offer to be sentenced to a conditional discharge, community service and payment of about $480 in restitution for out-of-pocket medical expenses.

However, the delay was requested by special prosecutor David Mashewske of Yates County and agreed to by Waterloo Town Justice Christopher Folk.

The charge stems from an altercation between Ruzicka and fellow board member David DeLelys on May 5, 2017, after a contentious board meeting.

The incident occurred at a downtown restaurant. Ruzicka is charged with grabbing DeLelys by the front of his shirt, pulling it upward and yelling at him before the two were separated.
