Seneca County’s legal battle to foreclose on tax-delinquent Cayuga Indian Nation properties is heading to the U.S. Supreme Court — again.
The first time, it got short-circuited when a Rochester law firm missed a crucial filing deadline.
That forced the litigation to basically start all over again.
At Tuesday night’s meeting of the Board of Supervisors Indian Affairs Committee, new legal counsel Brian Laudadio gave an update on the “do over” of the lawsuit.
Laudadio said the Seneca Falls-based Cayuga Nation sought an injunction prohibiting the county from foreclosing on their tax-delinquent properties.
“They based that on their claim of sovereign immunity from lawsuits and because their properties are reservation land under state and federal law and can’t be taxed,” Laudadio said.
