Clay mine case back in the spotlight

A motion to re-argue or appeal a Seneca Meadows landfill clay mine Fourth Department Appellate Court ruling should be rejected and denied.

That’s the basis of an affirmation filed by attorney Douglas Zamelis, who represents North Road property owner Dixie Lemmon and Concerned Citizens of Seneca County.

The Appellate Court ruled 5-0 on Feb. 3 to overturn the lower court decision of Acting State Supreme Court Justice Patrick Falvey in March 2016.

The issue is whether the landfill can build a haulageway road in a residential zone along the west side of Burgess Road to allow access and egress of trucks bringing clay and soil to and from the proposed 122-acre Meadow View Mine to the nearby landfill.
