Canandaigua man charged with DWI, DWAI after splitting utility pole while texting

On Wednesday at 10:45 pm deputies responded to County Rd. 30 near Outhouse Rd. in Canandaigua for the report of a property damage accident.

Upon arrival, deputies arrested Aaron J. Figenscher, 28, for driving while intoxicated and driving while ability impaired by drugs after he went off the side of the road and sheared a utility pole.

Deputies say that Figenscher admitted that he was texting while driving. No injuries resulted from the accident, and he was believed to be the only occupant.

He was transported to the Ontario County Sheriff’s Office where he submitted to a Datamaster DMT test to determine the amount of alcohol in his blood. The test concluded that he was driving with a blood-alcohol content of .08 or higher.

He also was found to be driving while his ability was impaired by drugs.

In all Figenscher was charged with driving while intoxicated, driving while intoxicated – per se, driving while ability impaired by drugs, driving while ability impaired by drugs and alcohol combined, and operating a motor vehicle while using a mobile device.

He will appear in Canandaigua Town Court at a later date to answer the charges.
