Rochester man charged with Kinney’s burglary in Seneca Falls

On Sunday at 9:55 pm the Seneca Falls Police Department arrested a Rochester man following an investigation into stolen merchandise at Kinney Drugs on State Route 5&20 in Seneca Falls.

Officers arrested 63-year-old Richard T. Depascale, of Rochester following the larceny investigation at Kinney Drugs Inc. in Seneca Falls.

Depascale was identified stealing merchandise on two separate occasions, passing all points of sale without any attempt at rendering payment for the items. He left the scene prior to police arrival and was never apprehended.

The first larceny took place on November 26th and the second on December 21st. After identifying the suspect, warrants were issued out of Seneca Falls Town Court.

Due to arrests made by other police departments at several other chains of Kinney Drugs — Depascale was banned from all Kinney Drug stores.

When he stole items from the store the second time he was charged with a higher level of crime. Due to both incidents, he was charged with two counts of petit larceny, a Class A misdemeanor and one count of third-degree burglary — a Class D felony.

With the assistance of the Rochester Police Department, Depascale was taken into custody without incident and extradited back to Seneca Falls. He was arraigned in the Seneca Falls Town Court where he was remanded to the Seneca County Correctional Facility on no bail.

Depascale is scheduled to appear back in court on February 2nd at 9:30 am to answer for the charges.
