With the pipeline that will carry natural gas from Milo to the Greenidge power plant basically completed, a lawyer for the state argued Tuesday that a lawsuit against the plant is “moot.”
Nicholas Buttino of the state Attorney General’s Office, representing the state Department of Environmental Conservation, said during arguments in Yates County State Supreme Court: “It’s too late. The lawsuit is also moot. There is no actual controversy in light of how far the project has progressed and what action they have failed to take to preserve the status quo.”
