Oral arguments in an Article 78 proceeding against the state related to its environmental review of the Greenidge power plant have been postponed. The arguments, which had been scheduled for Thursday, were reset for 1:30 p.m. Jan. 24 in state Supreme Court of Yates County. Ontario County Judge William Kocher, an acting state Supreme Court Justice, will hear the arguments.
An Article 78 proceeding challenges an action taken by a governmental body. The Committee to Preserve the Finger Lakes and the Coalition to Protect New York filed one in the fall. Construction of a natural gas pipeline to serve the plant is now underway. It will originate in Milo and cover 4.6 miles.
