Deputies in Ontario County say that a Fairport man was charged with aggravated driving while intoxicated after an investigation into an incident at Tops grocery store on Route 96 in Farmington.Employees of the grocery store called 911 after a male, later identified as David Fagan was smoking cigarettes in the store while stumbling around. He was later observed getting into a vehicle in the parking lot. When deputies arrived, they began investigating, which revealed Fagan had driven to the store. He failed a standard field sobriety test and was placed under arrest for driving while intoxicated. He later submitted to a breath test, which revealed his BAC to be above the legal limit. He was charged with driving while intoxicated, and aggravated driving while intoxicated. He was issued citations for both and released. He will answer the charges in Farmington Town Court at a later date.
