Victor man faces aggravated DWI charge – FingerLakes1.com Archive

The Ontario County Sheriff’s Office reports that a Victor man is facing aggravated DWI charges after a traffic stop on Maple Avenue, in Victor.On Saturday at approximately 7:06 pm a deputy was notified of a possible larceny was taking place on Maple Avenue by a citizen. When deputies investigated the incident, they learned that Thomas Biviano, 43, of Victor had allegedly stolen a food tray from a catering service at the Black Diamond Bar located at 61 Maple Avenue. He then allegedly entered his vehicle and was attempting to leave the scene when deputies stopped him. Biviano was found to be intoxicated and subsequently was charged with driving while intoxicated and aggravated driving while intoxicated. He was determined to have a blood-alcohol level of .18% or higher. The food tray was returned to the catering service and a petit larceny charge was not filed as result.Biviano will appear in Victor Town Court at a later date to answer the charge.
