Lago opponents vow to appeal court ruling

On the heels of Justice Falvey’s decision that the Town of Tyre acted legally in ruling that the Lago Resort & Casino would not have a negative impact on the community, Casino Free Tyre says that the process is not over.“Although we are disappointed with the decision, all of the parties have known that there would be an appeal, regardless of the outcome. We are hopeful that the appellate court will overturn this again, just as it did the last time this case was appealed,” Casin Free Tyre said in a statement.Last fall the appellate court ruled that Tyre needed to perform another review. However, in October the Town of Tyre found that the casino would have no negative impact.Thomas Wilmot Sr. said to FingerLakes1.com in an interview before the beam signing that litigation is often a part of the process. Whether it’s a residential real estate project, a mall, or casino, litigation comes with the territory. He said then that the biggest part for the development team is staying positive and letting the process take place.The Oneida Indian Nation has also filed suit against the New York State Gaming Commission, which alleges that the commission was subjective in awarding Lago Resort & Casino the license.
