For FanDuel and DraftKings it was another raucous day as the companies were first told they must immediately cease operation in New York State, and then just a matter of hours later – be told that they can remain operating until a final decision on the appeal is heard. While the temporary stay is a great win for FanDuel and DraftKings, the move has drawn a lot of criticism, showing just how polarizing the subject has become. New York Supreme Court Justice Manuel Mendez granted an injunction sought by Attorney General Eric Schneiderman Friday morning after hearing arguments last month over whether daily fantasy sports games amounted to illegal games of chance or lawful ones involving skill. This morning a lawyer for DraftKings said that they would be immediately filling for a stay to remain active until a final decision on the appeal was made. Following that statement, it would appear as though it took less than six hours for the state to walk back the brisk statement made this morning, after that injunction was granted.
