Follow-up to last week’s fatal crash in Barrington

Follow-up accident report to the fatal crash on Sunday, August 30, 2015 at 2:47 pm on Sturdevent Road in Town of Barrington, near state route 54. A farm tractor (1966 John Deere 3020) pulling a metal framed and decked hay wagon with several Mennonites riding on it, and some sitting on hay bales for afternoon rural countryside ride lost control on the steep hill of newly paved asphalt based roadway where the steel wheeled tractor lost its foothold, and the weight of the trailer caused it to jack-knife and went off the road into a ditch and broke apart, and the wagon came unhitched and continued on down the hill with some passengers jumping and it went into the same ditch stopping and ejecting others aboard.DECEASED: a passenger on the hay wagon ANNA MARIE MARTIN, age 52 of 4070 Fred Taylor Rd, Penn Yan, NY died at September 1, 2015 at Strong Mem. Hospital where she had been airlifted to after the accident due to her serious injuries. She was the aunt to the tractor operator.The farm tractor operator ELAM MARTIN age 25 of 4076 Fred Taylor Road, Penn Yan, NY was charged Monday Sept. 7 with appearance tickets:1. Unlicensed Operator.2. Speed not reasonable and prudent due to special hazards and existing legal conditions.3. Equipment violations, especially inadequate and no trailer brakes.4. Operating vehicle on pavement with metal wheel lugs protruding.He will appear in the Town of Barrington Court Sept. 16, 2015 to answer the vehicle and traffic charges.”Once the farm tractor and trailer were no longer being used for “agriculture purposes” it made it a motor vehicle unit,” said Sheriff Ron Spike, “several vehicle and traffic law violations then exist on its operation on a public highway.” The matter is being reviewed by the District Attorney office for any criminal charges, if applicable.
