On August 21st at approximately 3:36 pm the Penn Yan Police Department arrested 68 year old Bruce E. Harvey of 130 Water Street in Penn Yan after he mistakenly hit the accelerator of his vehicle while sitting at the Five Star Bank ATM. Harvey’s vehicle left the ATM, struck a curb, then struck a tree and fence on the Five Star Bank property.Upon interview with Harvey, officers detected the odor of alcohol as well as observed impairment. Harvey was placed through a series of field sobriety tests in which he failed. Harvey did submit to a chemical test which revealed a blood alcohol content of .11%.Harvey was charged with DWI and DWI .08 or Greater. He is to appear in the Village of Penn Yan Court at a later date to answer the charges.
