Lago Casino gets win in NYS Supreme Court

The New York State Supreme Court issued a decision in favor of Lago Casino in Tyre, Seneca County, on Monday morning. You can also download the complete decision from Acting NYS Supreme Court Justice Ferreira here (.pdf).Statement from Thomas WilmotToday’s decision by Acting Supreme Court Justice Ferreira is great news for everyone who supports economic development in Seneca County and Upstate New York.Acting Justice Ferreira issued a detailed nine page Order that squarely rejected Finger Lakes Racing Board’s attempt to challenge the New York State Gaming Facility Location Board’s decision to select Lago Resort & Casino.Acting Justice Ferreira ruled that the petitioner, ‘failed to establish that it has standing to commence this proceeding. As such, the petition must be dismissed.’ This ruling eliminates yet another roadblock for Lago Resort and Casino and reconfirms the integrity of the process that resulted in Lago’s selection.Our goal all along has been to build a world-class destination resort that will help bring increased tourism to the Finger Lakes region. This is a $425 million development that will create more than 1,200 union construction jobs. Once open, the resort will employ nearly 2,000 employees, not to mention the related jobs that will be created throughout the region.Acting Justice Ferreira reiterated that, ‘the clear overriding purpose of the statute is to promote economic growth, capitalize on development potential, boost economic development and create jobs and revenue.’ As he says in the ruling, ‘the statute expressly authorizes four new casinos and, in fact, promotes (Justice Ferreira’s emphasis) competition.’The New York Gaming Facility Location Board’s recommendation to award Lago Resort & Casino a license was properly determined. We welcomed the scrutiny that the process demanded and we have done exactly what the state required.The core issue is clear: well-funded and self-interested opponents of Lago Resort & Casino are opposed to competition and are trying everything within their power to delay approval and construction. It’s unfortunate and it conflicts with the will of New Yorkers and the State Legislature, which passed the New York State Gaming Act to allow for up to four full resort style Upstate casinos.Every day that Lago is delayed is a loss for the residents of Tyre, Seneca County and Upstate New York. More than 2,500 local residents have applied for jobs at Lago. We share their enthusiasm for the project and we look forward to the day when we can put many of these good people to work.
