The Seneca County Sheriffs Office reports that on Sunday morning around 9:00 am, deputies arrested Mark D. Derby, age 33 of 3001 Route 414 Apt. 1 in Seneca Falls, in the Town of Fayette for Driving while Intoxicated, aggravated DWI .18 BAC or more and for speed not reasonable/special hazard.Charges stem from a one car personal injury accident in the Town of Fayette. Deputies report Derby was eastbound on Marshall road when he failed to negotiate a curve and left the road striking a mailbox and utility pole, Derby’s vehicle then continued on approx 200 feet through the lawn before coming to rest.Derby was treated at the scene by North Seneca Ambulance for a left wrist abrasion and signed off for further medical treatment.Also assisting at the scene was the Border City Fire Department.The vehicle sustained damage and was towed from the scene.Derby was arraigned before the Town of Fayette Court , ROR’d and is to reappear before the Town of Fayette Court on 07/02/14 at 7 pm.
