On Sunday at 6:23 pm, Penn Yan Village Police responded to McDonald’s after a complaint that alcohol was being consumed inside a vehicle. Village Police stopped the reported vehicle on Sunset Ave. and identified the driver as Michael A. Scott, age 21 of Tyrone, NY.Police observed an odor of an alcoholic beverage coming from his person and asked Scott to perform several field sobriety tests which he failed. He was arrested and brought to the Yates County Public Safety Building for a breath test which revealed a .12% BAC.Scott was charged with DWI, DWI greater than .08%, AUO 3rd, unlicensed operator, and consuming alcohol in a motor vehicle.He was released and will appear in Penn Yan Village Court at a later date.
