Seneca County District Attorney Barry Porsch has determined that a Seneca County Deputy Sheriff was justified in shooting an individual on the evening of June 13, 2013 at 2945 Pre-Emotion Street in the Town of Waterloo, Seneca County.The Seneca County Sheriff’s Office conducted a thorough investigation and presented the District Attorney’s Office with a complete investigative file.The evidence shows that the Deputy’s use of force was legally justified pursuant to Article 35 of the Penal Law, and his actions in all aspects of the incident were proper. After the shooting, the Deputy rendered first aid immediately. The individual was transported to the hospital for treatment and released a few hours later.The Deputy’s statement of the incident was supported by sworn statements from three civilian eyewitnesses as well as by physical evidence recovered at the scene. There was no evidence to the contrary. As a result, a grand jury review of the Deputy’s actions is not necessary.
