In a Seneca County District Attorney news release, it was reported that on 12/21/2012, the NYS Supreme Court in Rochester affirmed the conviction of Curtis L. Mason, a former correction officer at Five Points Correctional Facility in Romulus.In March 2011, Mason was convicted in Seneca County Court of one count of official misconduct and sentenced to a nine month jail term. The sentence was immediately stayed by the Appellate Division.In the appeal, Mr. Mason argued that the county court erred in allowing the People to admit DNA evidence to trial thus making the jury verdict improper.The Appellate Division determined that the DNA evidence was direct and relevant evidence of the crime and so was properly admitted by county court. The matter has been remitted to the Seneca County Court for the imposition of the original sentence
