Conviction of Seneca Co. Inmate Upheld

In a decision rendered on July 8, 2011, the Appellate Division of the N.Y.S. Supreme Court in Rochester has unanimously affirmed the conviction of a State prison inmate, Jesus Torres, who was formerly housed at Five Points Correctional Facility in Seneca County. Torres was convicted of assault in the third degree in Seneca County Court on April 12, 2010 following a jury trial.The conviction stemmed from Torres kicking a correction officer in the head during a disturbance at Five Points. The Appellate Division rejected Torres’ argument that the County Court erred in refusing to instruct the jury on the defense of justification.Torres is presently serving his sentence at Great Meadow Correctional Facility and will be eligible for parole release in 2013. Torres was represented by attorney Steven Getman. The People were represented by Seneca County District Attorney Barry Porsch.
