On May 30, 2011 at approx. 11:13PM the Seneca Falls Police Department arrested Alan D. Derby, age 50 of 26 Chapin Street Lot #1 Seneca Falls, NY 13148. Police were called to 40 Oak Street for a fight in progress. While on scene witnesses stated that Derby was highly intoxicated and that he was fighting with two other individuals inside the residence. Residents inside the household refused to press charges on Derby at the time of the incident however they asked for him to be removed.While escorting Derby off of the property Derby then started yelling vulgar profanity and continued to do so even after being warned by police to stop. Officers then informed Derby that he was under arrest for disorderly conduct and when police approached him he started to fight and failed to comply with the officers. Officers were then quickly able to bring Derby into Custody. Derby was then charged with disorderly conduct and resisting arrest. Derby was then arraigned at the Town of Seneca FallsCourt in front of Judge Mahoney where he was then committed to the Seneca County Correctional Facility in lieu of $2,500 cash bail or $5,000 ins bond. Due to his high intoxication level Judge Mahoney ordered Derby to return to court on May 31, 2011 at 4:00PM.
