Man arrested for growing pot in Seneca Falls

On October 11th, 2009 at approx. 8:07 PM Seneca Falls Police arrested Benito V. Guzman Jr., age 31 from 25 Seneca Manor Drive Seneca Falls, NY for Endangering the Welfare of a Child and Unlawful Possession of Marijuana under the NYS Penal Law. Guzman was also charged with the misdemeanor of unlawfully growing Cannabis (marijuana) under the Public Health Law. On the above date at approx. 7:07 PM Seneca Falls Police were called to 25 Seneca Manor Drive for a trespass in progress. Further investigation into the trespass at this residence showed that Guzman was growing three marijuana plants in the living room of his residence. A further check of Guzman showed that he was in possession of a marijuana pipe containing marijuana. Guzman is also alleged to consume alcoholic beverages to the point of passing out, smoking marijuana, and growing marijuana while watching Guzman’s girlfriends eight year old daughter. Guzman was arraigned in the Seneca Falls Town Court in front of JudgeMahoney and ROR’ed to appear on October 28th, 2009 at 9:00 AM. A class A stay away order of protection was issued against Guzman to stay away from the eight year old child and Child Protective Services were notified.
